Lalo “Back to School GIveaway” Terms and Conditions

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

Please read these rules before entering Lalo’s “Back to School Giveaway” (the “Giveaway”). You agree that by entering this Giveaway, you will be bound by these Official Terms and Conditions (the “Rules”). 

Eligibility. This Giveaway is limited to legal residents of the 50 United States of America and the District of Columbia; it excludes residents of all other US territories, including but not limited to Puerto Rico. Entrants must be at least 18 years of age and cannot be employed by Host or Participating Companies (as defined below), nor can they be employed by any companies or agencies directly connected with this Giveaway, or be a household member or immediate family member of those employees. This Giveaway is subject to all applicable laws and regulations and is void where prohibited by law.

Host. This Giveaway is hosted by Lalo (“Host”) located [124 9th st unit 288 Brooklyn NY 11215]. The following companies are participating as prize contributors (collectively, “Participating Companies”): (1) The Honest Company, Inc.; (2) Eat Play Say; (3) Cadootz; (4) STATE bags; (5) Beekeeper’s Naturals.

Timing. The Giveaway will run from [7/23 to 7/29] (the “Giveaway Period”).

How to Enter. To enter the Giveaway during the Giveaway Period, you must:

1)  Follow all participating brands

2)  Like this post

3)  Tag 2 parents sending their little(s) to school

4)  Share to your story for a bonus entry!

Any attempt by any entrant to obtain more than the stated number of plays by using multiple/different accounts, identities, or any other methods will void that entrant’s plays and that entrant may be disqualified. Entries that do not comply with these Rules will be disqualified.

Prizes cannot be transferred, redeemed for cash or substituted by winner(s). Host and Participating Companies make no representation or warranty concerning the appearance, safety or performance of any prize awarded. Host and Participating Companies will not replace any lost or stolen prize items. Odds of winning a prize depend on the content of entry submissions and the number of eligible entries received during the Giveaway Period.

Number of Winners:  3 winner(s) will receive prizes. 

Prize Drawing, Winner Notification, and Announcement. Each potential winner will be selected at random]. Each potential winner will be notified via direct messages on Instagram from Lalo within [insert 3 days to contact winner] days after the conclusion of the Giveaway Period. If a potential winner does not respond within five (5) business days of being contacted, or refuses to sign and return the Affidavit of Eligibility and Liability/Publicity Release as well as a W-9 in the event that the dollar value of the prize is $600 or more, the potential winner forfeits the prize, and Host may, in its sole discretion, select an alternate prize winner from the pool of eligible entrants. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS SOLELY THE RESPONSIBILITY OF WINNER.

Publicity. Participation in the Giveaway constitutes each entrant's consent to Host’s and each Participating Company’s use of entrant's name, likeness or submissions for promotional purposes in any media, worldwide, without further payment or consideration.

Limitation of Liability and Release. Host and Participating Companies assume no responsibility for: (1) technical delays or failures of any kind, (2) unauthorized human intervention during any part of the Giveaway, (3) technical or human error during the administration or processing of the Giveaway, or (4) any loss, injury, or damage caused, whether directly or indirectly, in whole or in part, from downloading data or otherwise participating in the Giveaway. By entering into this Giveaway, entrants agree to release and hold harmless Host, Participating Companies, Instagram, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each company's officers, directors, employees and agents from and against any claim or cause of action, including, but not limited to, damage to or loss of property, arising out of participation in the Giveaway or receipt or use or misuse of any prize. In no event shall Host’s total liability exceed the retail value of the prize(s) awarded; in no event shall any Participating Company’s total liability exceed the retail value of the prize(s) awarded by the applicable Participating Company.

Social Media Disclaimer. This promotion is in no way sponsored, endorsed, administered by, or associated with Instagram. By entering, you release Instagram from any and all liability associated with, arising from, or relating to this Giveaway.

Additional Terms. Host reserves the right to cancel, suspend and/or modify the Giveaway, or any part of it, as determined by the Host in its sole discretion. Host reserves the right in its sole discretion to disqualify any individual it finds to be acting in violation of the Rules. Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Host reserves the right to seek damages from any such person to the fullest extent permitted by law.  

Applicable Laws and Jurisdiction. This Giveaway is subject to all applicable federal, state, and local laws and regulations. Issues concerning the construction, validity, interpretation and enforceability of these Rules shall be governed by the laws of the State of California, without regard to any principles of conflict of laws. All disputes arising out of or connected with this Giveaway will be resolved individually, and without resort to class action, exclusively by a state or federal court located in Los Angeles, California. Should there be a conflict between the laws of the State of California and any other laws, the conflict will be resolved in favor of the laws of the State of California. Judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys' fees) associated with participation in this Giveaway and shall not include any indirect, punitive, incidental and/or consequential damages.
